
General conditions of sale
1. Preamble
These general conditions of sale (hereinafter referred to as "Conditions") are concluded between
On the one hand, LES 3 C SAS, a company with a capital of 50,000 euros, registered with the Paris Trade and Companies Register under number 812 133 270 and located at 37 avenue de villiers 75017 Paris, hereinafter referred to as "LES 3 C",
And on the other hand, people, individuals or not, wishing to make a purchase via the online sales site (Internet)
www.marlot-paris.com, hereinafter referred to as the "Customers" or the "Customer" individually.
THE 3 C's and Clients together hereinafter referred to as the "Parties".
Packages can only be delivered within mainland France, Corsica and Monaco, as well as in Europe,
LES 3 C SAS sells its products exclusively remotely, either via the Internet (website or email), by telephone, fax, or postal mail. All products sold by LES 3 C are listed on the company's websites (hereinafter referred to as the "Products").
2. Purpose
These general terms and conditions aim to define the terms of sale between LES 3 C and its Customers, from ordering to delivery, including the use of the services made available by LES 3 C and payment. They regulate all the steps necessary for placing the order and ensure the monitoring of this order between the Parties.
If these terms and conditions should differ depending on the status of the Client, whether individual or company, these differences will be clearly stated.
3. Scope of application
These Conditions govern the sale of Products found on the LES 3 C SAS website on the day the order is placed by the Customer.
They apply to all ordering methods offered by LES 3 C, whether the order was placed online, by email, by telephone, by fax or by post.
If these Conditions should differ depending on the method of placing the order, these differences will be clearly mentioned.
4. The order
Capacity to contract
The purchase of a product found on the websites of the company LES 3 C is not an act of management of daily life, in view of compliance with article 1124 of the civil code, any customer of the company LES 3 C declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to be of legal age and not to be protected within the meaning of article 488 of the Civil Code.
LES 3 C reserves the right to refuse any order from a Customer with whom a dispute exists or arises during the processing of an order, in particular a payment dispute.
Acceptance of the Conditions by the Client
These Terms and Conditions may be read directly on the MARLOT-PARIS websites. Upon simple request from the Client, they may also be sent by email, fax or post.
The fact that the Customer checks the box "I have read the general conditions of sale and I accept them" before confirming his order automatically entails the express acceptance by the latter and without restriction or reservation of these Conditions. The Customer acknowledges by this act having read and understood these Conditions and accepts them.
Purchasing by email, telephone, fax or postal mail also implies acceptance of these Conditions, which he acknowledges having previously read, understood and accepted under the conditions mentioned above.
Product Features
In accordance with article L 111-1 of the consumer code, LES 3 C strives to present as best as possible, on the product technical sheets, the essential characteristics of the latter which the Customer must be aware of.
LES 3 C reserves the right to modify the assortment of Products depending in particular on constraints linked to its suppliers.
The information and specifications are those provided by the manufacturers. LES 3 C is in no way responsible for incorrect data provided by manufacturers.
The photographs and graphics presented on the sites or in emails sent by LES 3 C are given for information purposes only. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the Products cannot engage the responsibility of SAS LES 3 C.
SAS LES 3 C will make every effort to ensure that the photographic representation of the products on the MARLOT-PARIS website is as accurate as possible. However, it is possible that the perception of the product(s) does not fully correspond to the product(s). The product(s) are sometimes presented in photographs with other product(s). The description will mention what is or is not part of the product.
Unless otherwise specified on the site, all products sold by SAS LES 3 C are new and comply with current European Community legislation and standards applicable in France.
Date of order. The date of the order is deemed to be that:
- the date of validation of the order by the Customer in the event of payment by bank card online;
- the date of receipt of the check or transfer.
The deadlines indicated on the MARLOT PARIS website only run from the order date described above. However, the availability of the products remains that indicated on the website to the extent that the order has been validated online on the website and that the order date (effective payment) occurs within a reasonable period of time after the order validation date.
Price
Product prices are indicated in euros, all taxes included and shipping costs excluded. They take into account the VAT applicable on the day of the order. Any change in the applicable rate may be reflected in product prices after the date the new applicable rate comes into effect.
The VAT rate applied is a percentage of the value of the goods sold, 20% for delivery in Metropolitan France, Corsica and Monaco.
All prices are given subject to obvious typographical error or purely material computer labeling error.
The applicable price is that indicated on the SAS LES 3 C website on the date the order is registered by the Customer.
Shipping costs
Shipping costs are charged to the Customer depending on the delivery location and the mode of transport chosen.
They are indicated to the Customer before the final registration of the order.
Shipping costs may be offered free of charge on an ad hoc basis as part of MARLOT-PARIS promotional marketing operations.
Shipping costs can be viewed on the MARLOT-PARIS website under the "Delivery" section.
Discounts and gifts
Only one individual discount (e.g., promo code) is granted per order. When purchasing a product in multiple quantities, the discount only applies to the first copy, unless otherwise stated in the notification sent with the promotion or discount code. The same applies to free products (only one gift or set of gifts per Customer).
In the event that a computer problem results in duplicate discounts or gifts, the invoice will be blocked until payment is regularized or the order is canceled.
Gifts are offered based on the product purchased. These gifts are listed on the product pages in question or in the personalized offer sent to the Customer.
Discounts, promotional codes, gifts, or vouchers are valid within the end dates mentioned either on the MARLOT-PARIS website, or in the mail or email accompanying the description of the special offer, and while stocks last.
If the customer is entitled to gifts, they must ensure that they are listed on the order form. If this is not the case, they must contact SAS LES 3 C's customer service.
The customer cannot claim any reduction or compensation in the event that he refuses the gifts offered to him, LES 3 C covering all costs relating to these gifts, including shipping costs.
Gifts are not guaranteed, returned or exchanged.
Placing an order
The private Customer can place his order with SAS LES 3 C either via the Internet on the MARLOT-PARIS website, or by email, or by telephone, or by fax, or by post.
When the order is placed by email, fax or post, the order must include the information necessary to process it properly.
In all cases, the Customer's identification allowing the order to be recorded must contain at least the following information:
- the Customer must identify himself either using his Customer number or by providing all the information usually requested for online registration;
- The Customer must clearly identify the selected products with the references indicated on the MARLOT-PARIS website, references including the color options, sizes, etc. In the case of products with options, these precise references appear when the correct options are selected;
- The Customer must also indicate the quantities requested;
- The Customer must also clearly indicate the information necessary for delivery. This concerns in particular the precise delivery address as well as any accessibility restrictions at the delivery location (refer to the paragraph concerning deliveries);
- The Customer must indicate the chosen delivery method;
- Finally, the Customer must also indicate the chosen payment method.
Product Availability
Les 3 C works, depending on the products, on the basis of a just-in-time stock or direct order from its suppliers. Therefore, depending on the case, the products are available within the limits of stocks available at LES 3 C or subject to stocks available from its suppliers.
Products available in LES 3 C's stock for fast delivery are marked "Shipped within 48 to 72 hours". Product availability can vary rapidly depending on sales. LES 3 C updates availability very frequently, but cannot be held responsible if the stock is no longer the same as indicated. More detailed information can be provided to the Customer by telephone, email or fax.
The unavailability of a product is also mentioned on the page of the product concerned. Thus, the products may appear with the mention of a shipping time frame such as "2 to 4 days", "2 to 4 weeks", etc., "Out of stock", Product not available".
Availability may also vary within a day depending on sales levels.
The shipping times indicated in the description sheets are indicative times when the product(s) are not available in LES 3 C stocks. They may therefore be subject to variations for which the Customer will be informed by LES 3 C in their order tracking in the event of a slight delay or by email in the event of a prolonged delay.
No cancellation compensation (other than a full refund of the order) may be requested, such unavailability resulting from the delay in updating these unavailabilities.
LES 3 C only undertakes to honor orders received within the limits of available product stocks. In the event of unavailability of the product(s), LES 3 C undertakes to inform the Customer as soon as possible.
In the event of unavailability, LES 3 C may offer the Customer a product of equivalent quality or price. The Customer's formal agreement will then be requested by LES 3 C before any shipment.
Order confirmation
An email is automatically sent to the Customer to confirm the order, provided that the email address indicated in the registration form does not contain any errors.
LES 3 C does not send order confirmation by post or fax.
5. Cancellation of the order
Before dispatch by LES 3 C or before receipt by the Customer
LES 3 C offers its Customers the option to cancel their orders at any time. This option extends the legal cancellation conditions provided by law after receipt by the Customer.
Several cases arise:
The order has not been shipped: the cancellation is then taken into account immediately by LES 3 C;
In this case :
The Customer must contact the sales department of SAS LES 3 C to notify this cancellation prior to any reshipment of the product. Written confirmation will be requested from the Customer, either by email or by post, to avoid any cancellation by anyone other than the Customer.
This possibility of cancellation entails costs for LES 3 C, flagrant abuses (repetition deemed abnormal of cancellations by the same Client), LES 3 C then reserves the right to invoice the Client for its management and cancellation costs.
Exchange or obtain a voucher after receipt or shipment
The law guarantees the Customer the possibility of canceling his order within 14 working days after receipt. 14 days during which all products can be exchanged for another product reference or a purchase voucher, except those bearing a contrary mention.
In all cases, the exchange or purchase voucher must be requested from the sales department of SAS LES 3 C by mail or email, prior to any reshipment of products.
LES 3 C cannot accept cancellations or exchanges of part of a product listed. For example, in the case of a sale in batches (sets), the Customer may only exchange or cancel the entire batch.
The Customer may request a cash refund for their order by registered letter with acknowledgment of receipt (according to the recommendations of the DGCCRF). The refund will then be made within 30 days of receipt of the Customer's letter, in accordance with Article L.121-20-1 of the Consumer Code.
Case of exchange
The exchange must take place within 14 days from the date of receipt of the product in question. If the new product reference requested in exchange is for a higher amount, the Customer must pay the difference before shipping the new product. Conversely, if the amount is lower than the initial amount, the Customer's account on www.marlot-paris.com will be credited with this difference in the form of a credit note. The shipment of the new product can only be carried out after the exchanged product has been returned.
Case of cancellation
Cancellation must be made within 14 days of the date of receipt of the product in question. The Customer must send their request in writing (email or postal mail) to the sales department of SAS LES 3 C. The cancellation will be processed within 72 hours, on working days. A credit note will then be issued. The Customer may use this credit note at their convenience on www.marlot-paris.com.
The Customer may also request a cash refund for their order within 14 days of receiving the product in question. The refund request must be made by registered mail with acknowledgment of receipt (according to the recommendations of the DGCCRF). The Customer will then receive a refund by check upon receipt of the product within 14 days of receiving the letter. The flat-rate processing and shipping costs for the order may be deducted from this refund.
The right of withdrawal follows the same rules but applies to all products included in the order.
Conditions relating to exchanges and refunds
The right to exchange or refund only applies if the product is returned in perfect condition for resale, packaged in its original packaging, complete and showing no signs of dirt or use. LES 3 C reserves the right to refuse this exchange or refund if the products received in return do not comply with these conditions.
The return of refunded or exchanged products is the responsibility of the Customer, unless otherwise specifically stated for certain items on the marlot-paris sites.
Return conditions:
Any return without exception must be preceded by a call and acceptance by LES 3 C. Les 3 C will then indicate to the Customer the procedure to follow. Les 3 C reserves the right to refuse receipt of a return to its warehouses which has not been notified to it or which does not follow the prior instructions. A return which does not respect this procedure and for which the package(s) has/have been lost during transport could not be considered by LES 3 C. No compensation or reimbursement would then be required by the Customer who has not followed the instructions of the customer service.
6. Payment
Payment methods
When a Customer is an individual, he can pay for his order:
- Online on the marlot-paris website by bank or credit card (Carte Bleue, Visa, Eurocard, Mastercard);
- By check made out to SAS LES 3 C
In the case of an order by email, due to the lower level of security of this means of communication, LES 3 C cannot accept payments by credit card in order to ensure the security of payment for its Customers. Orders by email require payment by check.
The Customer guarantees to LES 3 C that he has any necessary authorizations to use the payment method chosen by him.
LES 3 C implements all necessary means to ensure the security and confidentiality of data transmitted online (online payment on the MARLOT-PARIS sites). To this end, the LA SAS LES 3 C site uses a secure SSL (Secure Socket Layer) payment method. The transaction is carried out via a reputable bank which alone has access to the banking information provided on the site at the time of payment.
Bill
The order form that the Customer establishes online or the order confirmation sent by email to the Customer by LES 3 C does not serve as an invoice. Regardless of the ordering and payment method chosen, the customer has the original invoice in their online account tracking.
LES 3 C keeps an electronic copy of each invoice.
In the case of delivery to an address other than the billing address, the invoice is in any case only available in the online order tracking of the Customer's account and is therefore not attached to the packages.
Payment date
In the case of a one-time payment by credit card, the Customer's account is debited at the end of the transaction. This period may vary depending on the type of payment card and the Customer's bank.
When products are unavailable, LES 3 C may, at the Customer's request, make a partial shipment of products of the same type. However, the Customer may be asked to pay additional shipping costs corresponding to this or these additional packages.
In the case of payment by check, collection is made upon receipt of the check, thus notifying the validity of the Customer's order.
Late payments
In the event of a bank refusal of a credit card debit or refusal to cash a check or other means of payment, it is the Customer's responsibility to contact customer service in order to pay for their order by any means of payment.
Transfer of ownership
LES 3 C remains the owner of the delivered products until their full payment by the Customer. The above provisions do not prevent, upon delivery of the products, the transfer to the Customer of the risks of loss or deterioration of the products subject to retention of title as well as any damage they may cause.
7. Delivery
Shipping times
Orders placed online via the MARLOT-PARIS website are collected every morning from Monday to Friday. LES 3 C processes all orders recorded the day before during the day up to the time of collection.
The preparation of an order can in principle last up to two working days including in particular the processing of the order, the preparation of the products, the packaging and the invoicing before the dispatch of the available products.
However, depending on the payment method adopted, this period may be different:
- For online payment by credit card, the deadline is two working days;
- For payment by check, the two working day period starts from the date of receipt of payment by LES 3 C.
LES 3 C informs its Customers that these deadlines do not include Saturdays, Sundays and public holidays.
In the event of partial unavailability of products, LES 3 C may be required to split shipments. Thus, the available products may be shipped first, with the balance of the order being shipped when the other products are available, without generating any additional cost for the Customer.
An email is automatically sent to the Customer when the products are shipped, provided that the email address indicated in the registration form does not contain any errors.
Transport times
LES 3 C provides Customers with information on the delivery times announced by the chosen mode of transport. This information is provided when the Customer chooses the mode of transport or carrier at the end of the online ordering process, before confirming the order.
However, LES 3 C informs its Customers that the announced delivery times do not include Sundays and public holidays.
Transport times can be viewed on the marlot-paris website in the "returns & Delivery" section.

delivery times may be as follows:
- If the products are available, the delivery time is equal to the order preparation time and the postal time
- If the products are not available, the restocking times of the manufacturers of SAS LES 3 C are added to the order preparation times and the postal time.
Packaging
The products are packaged in such a way as to comply with the current transport standards, and to ensure optimal protection of the Products during their delivery. The Customer is requested to respect these same standards when returning a product, whether for after-sales service, or for a return for convenience. Any damage noted on a product upon return due to a problem with the level of packaging not respected may result in a partial refund or non-refund of the product in the event of impossibility of resale in the state or in the event of aggravation of the technical problem indicated.
Order tracking
The Customer can check the status of their order at any time on the marlot-paris website by consulting their account. This tracking allows the Customer to know the processing status of their order, but also the shipping or delivery status of their packages. This last delivery tracking is carried out in interface with the carriers' Internet tracking means. LES 3 C cannot therefore be held responsible for unavailability or errors that may affect the information provided by its carriers. Les 3 C nevertheless strives to make this information as clear as possible and to make transport with its carriers as reliable as possible.
The Customer may contact the sales department of LES 3 C at any time to be informed of the progress of their order.
Delivery services
LES 3 C provides its Customers with various delivery methods which can be consulted in more detail on the MARLOT-PARISL website in the "delivery & returns" section.
However, LES 3 C reminds its customers that:
- The delivery address (which may be different from the billing address) must be correct and include all the details necessary for proper delivery;
- For delivery by appointment, the Customer must clearly provide a landline and/or mobile phone number at which they can be easily reached;
- An error in the delivery address, delivery location, accessibility of the location, telephone number for making an appointment, absence of the Customer at the scheduled appointment, or any other problem resulting in the need to make a new delivery may be subject to invoicing at the actual cost of the new delivery, the payment of these additional costs alone allowing the new delivery.
8. The 3 C guarantees
- Strikes
In the event of a strike by La Poste or carrier services or any other exceptional event slowing down or preventing the delivery of parcels, LES 3 C will do everything possible to inform the customer of the status of the shipment of their parcel, but cannot be held responsible for any delays caused.
Complaints:
In the event of difficulty in the application of this contract, the customer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a consumer association or a professional organization in the sector, or any other advisor of his choice.
9. Signature, data protection, payment security
In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose all of your personal data at any time by writing to SAS LES 3 C - 37 avernue de villiers 75017 PARIS, providing proof of your identity.
Furthermore, in this context, LES 3 C may be required to ask the customer for all the documents necessary to release the order: proof of address, identity document, etc.
Personal and nominative data
Visitors or Customers of the SAS LES 3 C Sites have the right to access, modify, rectify and delete data concerning them at any time in accordance with Article 34 of the "Data Protection" Act of 6 January 1978.
When registering a Customer or placing an order, or as part of other specific operations, LES 3 C offers visitors or Customers the opportunity to receive its newsletters, promotional offers, and/or to register to be informed of its "promotions" or "marketing events". The visitor or Customer may modify their subscription at any time through their personal account, or through the hyperlink appearing at the bottom of offers received by email.
LES 3 C may also offer its visitors or Customers the opportunity to receive promotional offers from its partners. LES 3 C reserves the right to collect data about the Customer, including through the use of cookies. LES 3 C may, for commercial purposes, transmit the identity and contact details of its visitors or Customers to commercial partners. LES 3 C explicitly offers the visitor or Customer the option to object to the disclosure of this personal data and may change their choice at any time on the MARLOT-PARIS Website or by contacting the sales department of SAS LES 3 C.
LES 3 C undertakes to effectively take into account changes to subscriptions and partial or total unsubscriptions to commercial emails sent by it on behalf of its sites or its partners as soon as possible, depending on the necessary processing.
LES 3 C informs its Customers that the processing of this nominative and/or personal information has been declared to the CNIL.
10. Intellectual Property
All elements of the SAS LES 3 C Sites, whether visual, graphic, video or audio, including the underlying technologies used, are protected by copyright, trademarks or patents. They are the exclusive property of the company LES 3 C.
Any person with a website wishing to place a simple link on their site directly to the MARLOT-PARIS Sites must request authorization from SAS LES 3 C. An authorization given by LES 3 C will in no case constitute an implicit agreement of affiliation and will in no case be given definitively. Upon simple request from SAS LES 3 C, this link must be removed.
Any hyperlink to the MARLOT-PARIS Sites using techniques such as "framing" or "in-line linking" is strictly prohibited.
11. Retention of Title Clause
In accordance with the provisions of Articles 2367 et seq. of the Civil Code, the products sold on the website www.marlot-paris.com remain the property of Marlot Paris, hereinafter referred to as "the Seller", until full payment of the price by the Buyer.
In the event of total or partial non-payment of the price by the agreed due date, the Seller may claim the delivered products, without prejudice to any other action. The Buyer undertakes to keep the products in their current condition until the effective transfer of ownership and to immediately inform the Seller in the event of seizure or any other intervention by a third party on said products.
The risks (loss, theft, deterioration) are transferred to the Buyer upon delivery of the products. The Buyer therefore undertakes to take out insurance covering the risks associated with the products until the transfer of ownership.
12. Entire Conditions
A change in legislation, regulation or a court decision rendering one or more clauses of these General Terms and Conditions of Sale null and void shall not affect the validity of these General Terms and Conditions of Sale. Such a change or finding shall under no circumstances allow the Customer to fail to comply with these General Terms and Conditions of Sale.
If a condition was not explicitly mentioned, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their headquarters in France.
Duration and application
These Conditions apply to all purchases made on the MARLOT-PARIS Site as long as the stores are online.
These Conditions, precisely dated, are subject to change at any time by LES 3 C. The applicable Conditions are those in effect on the date the order is registered. The last date of modification of these General Conditions of Sale appears at the bottom of these conditions.
Territoriality and applicable law
Customers who order via the MARLOT-PARIS website exclusively in French are deemed to be purchasing in France and are therefore subject to French law.
In the event that the Customer is a professional placing an order as part of their professional activity, jurisdiction in the event of a dispute, and in the absence of an amicable agreement between the Parties, will be given to the competent courts of Lille.
